1. Acceptance of These Terms

The Site is owned and operated by Five Oceans SFO FZCO (collectively, “Five Oceans,” “we,” “our,” or “us”). By accessing, browsing, or otherwise using the Site, you (“you” or “your”) acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site.

2. Informational Purpose Only; No Offer or Solicitation

(a) Five Oceans is a single family office. The Site is provided solely for the purpose of conveying general information regarding Five Oceans and its investment philosophy.

(b) Nothing on the Site constitutes, or is intended to constitute, (i) an offer to sell, a solicitation of an offer to buy, or a recommendation of any security, investment product, or investment service, (ii) investment, legal, accounting, or tax advice, or (iii) a representation that any investment or strategy is suitable or appropriate to your individual circumstances.

(c) As a single family office, Five Oceans invest their own capital across private and public markets, both regionally and internationally. No element of the Site is directed to, or intended for, any person or entity in any jurisdiction in which such distribution, publication, availability, or use would be contrary to applicable law or regulation.

Subject to your continued compliance with these Terms, Five Oceans grants you a personal, non-exclusive, non-transferable, revocable, limited license to access and use the Site solely for your own non-commercial, informational purposes. You must retain, without modification, all proprietary notices displayed on or contained within the Site or any content downloaded from the Site.

The Site is purely informational and does not on its own request personal data from visitors however, some personal data may be processed vicariously by virtue of using the Site. Personal Data processed on the Site will be in accordance with our Privacy Policy, the terms of which are hereby incorporated into and form part of these Terms.

7. Disclaimer of Warranties

The Site and all Content are provided on an “as-is” and “as-available” basis. Five Oceans makes no representations or warranties of any kind, express or implied, with respect to the Site or the Content, including (without limitation) warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Five Oceans or its members, managers, officers, employees, or agents be liable for any indirect, consequential, incidental, special, punitive, or exemplary damages, including (without limitation) lost profits, even if advised of the possibility of such damages. Without limiting the foregoing, Five Oceans’ aggregate liability to you for any and all claims arising out of or relating to these Terms, the Site, or the Content shall not exceed one hundred United Arab Emirates Dirhams (AED 100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Five Oceans and its members, managers, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable legal counsel’s fees) arising out of or in any way connected with (a) your breach or violation of these Terms, or (b) your use of the Site or any Content.

10. Modifications and Termination

Five Oceans reserves the right to (a) modify, suspend, or discontinue the Site or any part thereof, (b) modify these Terms, or (c) terminate your access to the Site for any reason, all without notice or liability. Your continued use of the Site following the posting of any changes to these Terms constitutes your acceptance of those changes.

11. General Terms

(a) Relationship: None of the provisions of these Terms will be deemed to constitute a partnership or agency between you and Five Oceans and you will have no authority to bind the Company in any manner whatsoever.

(b) Severability: If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal or unenforceable and can be deleted without altering the essence of these Terms, the invalid, illegal or unenforceable provision will be severed and the remaining provisions will remain in full force or effect.

(c) No Waiver: Any failure by the Company to enforce any terms set out in these Terms or other policies with you is not a waiver of the Company’s rights to enforce those terms.

12. Governing Law and Jurisdiction

The Terms shall be governed by the laws of Dubai, United Arab Emirates. Any dispute regarding these Terms shall be subject to the exclusive jurisdiction of the Courts in Dubai. If any portion of the Terms is held to be unenforceable, invalid or illegal by any court of competent jurisdiction, the remainder of the Terms shall not be affected.

This Privacy Policy (“Policy”) forms part of the Terms of Use (“Terms”) relating to the use of website located at www.fiveoceansglobal.com (“Site”) which is owned and operated by Five Oceans SFO FZCO (collectively “Five Oceans,” “we,” “us,” or “our”).
